About the Distance and Home Sales Act
Internet shopping, mail order and telephone sales are regulated in the Distance and Home Sales Act.
The law also applies when you buy something from a seller who comes to your door.
When does the law apply?
Distance agreement
Common distance contracts are when you shop by mail order, from a TV shop, via the Internet or by a telephone salesman. The Distance and Home Sales Act applies to such agreements.
Home sales
If there is a knock on the door at home and you buy something from a seller standing up, the same law applies.
Financial services
The law also applies to financial services, for example if you take out home insurance via the Internet. If you sign a distance agreement on a life insurance or private individual pension savings, you have a 30-day right of withdrawal.
More uses
The Distance and Home Sales Act also applies when you buy something from a seller who is outside their regular point of sale, for example at so-called Home Parties or at your workplace, on a train, in a hospital or elsewhere where you may have difficulty getting away from the seller. . However, the law does not apply to so-called canvas sales. This can, for example, be about street sales or sales in connection with a shopping center.
The most important parts of the law for you as a consumer are the right of withdrawal and the information you have the right to receive.
The right of withdrawal
When you buy a product or service remotely or at home sales, you have the law according to the law to cancel the purchase
within 14 days, when you shop in Sweden. If you buy something from another EU country, for example via the Internet, you also have the right to withdraw, but the withdrawal period can then be shorter than 14 days. Information
For home sales, you must also receive a form that you can use if you want to cancel the purchase, as well as receive an information document. It must, among other things, contain information about the right of withdrawal and the address and telephone number of the person you should contact if you regret it.
Return shipping
If you regret buying an internet or mail order, you will have to pay the return postage yourself. If you regret telephone sales, you should not have to pay return shipping. If you regret selling at home, keep the item available so that the seller can pick it up from you. An exception is if the product has been delivered after the actual home visit. Then you must return the item yourself, but are entitled to reasonable compensation for return shipping. ”
